എറണാകുളം: പാലക്കാട് നഗരസഭ കെട്ടിടത്തില് ജയ്ശ്രീറാം’ ബാനര് തൂക്കിയ സ്ഥലത്ത് ഡിവൈഎഫ്ഐ പ്രവര്ത്തകര് ദേശീയ പതാക ഉയര്ത്തിയ സംഭവത്തില് യുവമോര്ച്ചയും ബിജെപിയും പരാതി നല്കിയിരുന്നു. ദേശീയ പതാക ഉയര്ത്തിയ ഡിവൈഎഫ്ഐയുടെ നടപടി ഫ്ളാഗ് കോഡിന്റെ ലംഘനമാണെന്നായിരുന്നു ആരോപണം. വിഷയത്തില് വിശദീകരണവുമായി രംഗത്ത് വന്നിരിക്കുകയാണ് ലൈല് ലോ എഡിറ്റര് മനു സെബ്സ്റ്റ്യന്. ഫേസ്ബുക്കിലൂടെയാണ് ഡിവൈഎഫ്ഐയുടെ നടപടി ഫ്ളാഗ് കോഡിന്റെ ലംഘനമാണോ എന്ന് മനു സെബാസ്റ്റ്യന് വിശദീകരിക്കുന്നത്.

ഫ്ലാഗ് കോഡിന്റെ പറ്റി :’ജയ് ശ്രീറാം’ പോസ്റ്ററിനുള്ള ഉത്തമ മറുപടിയാണ് ഡി.വൈ.എഫ്.ഐ. മുനിസിപ്പാലിറ്റി ഓഫീസില് ദേശീയ പതാക ഉയര്ത്തുക വഴി ചെയ്തത്.ഇത് ‘ഫ്ലാഗ് കോഡിന്റെ’ ലംഘനം ആണ് എന്ന് വാദിച്ചു ചിലര് രംഗത്ത് വന്നിട്ടുണ്ട്. ദേശീയ പതാകയോടുള്ള സ്നേഹം കൊണ്ടൊന്നുമല്ല സ്ഥിരം കുത്തിത്തിരിപ്പ് ഉണ്ടാക്കാന് ആണ് ഈ വാദമൊക്കെ എന്ന് സുബോധമുള്ളവര്ക്ക് വ്യക്തമാണ്.
എന്തായാലും, ഇതിന്റെ നിയമത്തിലേക്ക് വരാം. ഈ ‘ഫ്ലാഗ് കോഡ്’ എന്ന് പറയുന്നത് ഒരു നിയമം അല്ല. അത് സര്ക്കാര് സ്ഥാപനങ്ങളിലും ഔദ്യോഗിക ചടങ്ങുകളിലും ദേശീയ പതാക ഉപഗോയിക്കുന്നത് സംബന്ധിച്ചു കേന്ദ്ര ആഭ്യന്തര മന്ത്രാലയം പുറപ്പെടുവിച്ച ചില മാര്ഗനിര്ദേശങ്ങള് ആണ്.
ഇത് ഒരു സാധാരണ വ്യക്തി പാലിക്കേണ്ടതുണ്ടോ എന്ന വിഷയം ‘നവീന് ജിന്ഡാല്’ കേസില് കോടതി പരിഗണിക്കുകയുണ്ടായി.
അതില് ഡല്ഹി ഹൈക്കോടതി പറഞ്ഞത് ‘ഫ്ലാഗ് കോഡ്’ ഒരു നിയമം അല്ലെന്നും അത് ലംഘിച്ചു എന്നത് കൊണ്ടു മാത്രം ഒരു കുറ്റകൃത്യം സംഭവിക്കുന്നില്ല എന്നുമാണ്. പതാകയെ അപമാനിക്കുന്ന തരത്തിലുള്ള Prevention of Insults to National Honour Actന്റെ അല്ലെങ്കില് The Emblems and Names(Prevention of Improper Use)Act ന്റ്റെ പരിധിയില് വരുന്ന കുറ്റകരമായ കാര്യങ്ങള് ഇല്ലെങ്കില് ഫ്ലാഗ് കോഡ് പാലിച്ചില്ല എന്നത് കൊണ്ട് മാത്രം കുറ്റം ആകുന്നില്ല.
‘Flag Code – India is not law and its contravention cannot be enforced unless of course the contravention of any instructions/guidelines of the Flag Code comes within the purview of the Emblems Act or the Prevention of Insult to National Honour Act. we hold that any restriction contained in the Flag Code – India relating to the flying of National Flag by the citizens cannot be enforced except when contravention of those restrictions come within the purview of any law in force.The restrictions imposed by the Flag Code on flying the National Flag being not law within the meaning clause (2) of Article 19 of the Constitution of India, the same cannot be construed to be a penal provision; However, if contravention of any of those instructions and guidelines had been issued under the 1950 Act or under the Prevention of Insults to National Honour Act, 1971 (hereinafter referred to as ‘the 1971 Act’), the same would constitute a penal offence’, എന്നാണ് ഡല്ഹി ഹൈക്കോടതി പറഞ്ഞത്.
ഇത്, 2005ല് സുപ്രീം കോടതി ശരി വച്ചു.’Flag Code is not a law within the meaning of Article 13(3)(a) of the Constitution of India for the purpose of clause (2) of Article 19 thereof. It would not restrictively regulate the free exercise of the right of flying the national flag. However, the Flag Code to the extent it provides for preserving respect and dignity of the National Flag, the same deserves to be followed’, എന്ന് സുപ്രീം കോടതി പറഞ്ഞു .
പതാകയുടെ അപമാനം ആകുന്ന പ്രവര്ത്തികള് എന്തൊക്കെയാണ് എന്ന് Prevention of Insults to National Honour Actല് കൃത്യമായി നിര്വചിക്കുന്നുണ്ട്. പതാകയെ പൊതുസ്ഥലത്തു നശിപ്പിക്കുക, കത്തിക്കുക, വികലമാക്കുക, ചവിട്ടുക, നിലത്തിട്ടു വലിച്ചിഴയ്ക്കുക, അരയ്ക്ക് കീഴ്പോട്ടുള്ള വസ്ത്രത്തിന്റെ ഭാഗമാക്കുക മുതലായ കാര്യങ്ങള് ആണ്.
ഇവിടെ dyfiക്കാര് ചെയ്ത പ്രവര്ത്തിയില് പതാകയെ അപമാനിക്കണം എന്ന ഉദ്ദേശം ഒരു തരത്തിലും വായിച്ചെടുക്കാന് കഴിയില്ല. മറിച്ചു, ഭരണഘടനയുടെ അന്തസ്സ് ഉയര്ത്തിപ്പിടിക്കുന്ന ഒരു പ്രതീകാത്മ പ്രവര്ത്തിയാണ്. മതനിരപേക്ഷ മൂല്യങ്ങള് സംരക്ഷിക്കുന്നതിന് വേണ്ടിയുള്ള, നാനാത്വത്തില് ഏകത്വം എന്ന മഹത്തരമായ ഭാരതീയ സങ്കല്പം നിലനിര്ത്താനായുള്ള ഒരു പ്രതിരോധം ആണ്. ഈ വിശാലമായ അര്ത്ഥവും ലക്ഷ്യവും കാണാതെ, ‘flag code’ ലംഘിച്ചു എന്നൊക്കെ പരാതി പറയുന്നത് വെറും കുത്തിത്തിരിപ്പാണ്.
